UP News: The Supreme Court gave an important decision on Friday. Let us tell you that the Supreme Court stayed the order of Allahabad High Court in which it had declared the Uttar Pradesh Madrasa Act unconstitutional. Let us tell you that last month Allahabad High Court had declared the Uttar Pradesh Madrasa Education Board Act, 2004 as a violation of the principle of secularism. The same High Court had ordered the UP government to provide formal school education system to the students, however now the Supreme Court has banned it.
What did the Supreme Court say?
A three-judge bench of the Supreme Court headed by Chief Justice DY Chandrachud has issued notice to the Central and Uttar Pradesh governments. The Supreme Court said that the High Court has misinterpreted the provisions of the Madarsa Act. Because it does not provide religious education. The court further said that while the High Court order will “impact” the future of education of all 17 lakh children, we are of the view that this direction was prima facie not appropriate. The Supreme Court argued that we are of the view that the issues raised in the petitions should be carefully considered. We are willing to issue notice, the Supreme Court said while issuing notice on five special leave petitions filed against the High Court order.
UP News: What is the whole matter
According to reports, a petition was filed by lawyer Anshuman Singh Rathore. In the petition, Rathod had challenged the constitutionality of the UP Madrasa Board. Apart from this, the petitioner had objected to the management of madrassas by the Minority Welfare Department instead of the Education Department. After this, this decision came from Allahabad High Court last month.
