What would you say if an employee of a company is on leave due to illness and still goes to court for not increasing his salary? this shocking case IBM Company belongs to. According to media reports, one working in this company IT department employee since 2008 sick leave is on (sick leave). He has gone to court alleging discrimination against his company IBM for not increasing his salary.
In fact, according to information received from media reports, Ian Clifford works in the giant IBM. But he is ill for the last 15 years. And according to Ian’s LinkedIn profile, he has been medically retired since 2013.

However, despite this, Ian has claimed in the court that his salary was not increased during the 15-year leave. Explain that under the IBM Health Plan, IT specialist Ian Clifford gets more than 54,000 pounds (about Rs 55 lakh) in a year and he will continue to get it as salary till the age of 65. But, the employee argues that the health plan was not good as his salary would be eroded over time due to inflation.

According to media reports, Ian went on leave for the first time in September 2008 due to illness and things remained the same till 2013. Considering his complaint, IBM made a ‘compromise’ where he was placed on the company’s disability plan so as not to be fired. Under this scheme, a person who cannot work is not dismissed and remains an employee of the company but has no work obligation.
Will get salary till the age of 65
Ian’s agreed salary under the scheme was £72,037, which means from 2013 he will be paid £54,028 a year after a 25 per cent cut. This scheme was fixed for more than 30 years i.e. till he reaches the retirement age of 65 years.
Tribunal hearing
At the same time, in February 2022, Ian went to an employment tribunal court to IBM, claiming discrimination for disability. However, the company said that the plan was to protect those employees who were not able to work. He said that even this would not have been received if the salary was stopped forever.
Inactive employee’s salary cannot be increased: Court
At the same time, the court rejected Ian’s claims and said that he has been given very adequate benefits and treatment. Judge Housego said that the salary of the working employee can be increased, but not of the inactive employee. The court said that ‘the claim is that the reason for non-increase in salary is discrimination. This charge is not tenable because even if £50,000 is worth half in 30 years, it is still a huge profit.
