As soon as Joe Biden occupied American power, the troubles of millions of Indians were reduced. In fact, the Joe Biden government of America has agreed to authorize the spouses of H-1b visa holders to work automatically. That is, now they will not have to get themselves authorized again. Spouses of working people working in the US with h1b visas can now find work in the US. This decision will benefit the wives and husbands of thousands of Indians working in the IT sector in America.
The H-1B visa is a non-immigration visa that allows US companies to employ foreign workers. Because of these technology companies hire thousands of people every year from countries like India and China. The American Immigration Lawyers Association filed a lawsuit on behalf of the migrants’ spouses a few months ago, following which the Department of Homeland Security reached a settlement.
Joan Wasden of the AILA, in her petition, said that H4 visa holders are people who meet regulatory conditions for extension along with employment tribunal documents. But they do not get the benefit of it and have to be forced to re-authorize.
Wasden said that due to these not being approved, people are suffering and losing high-paying jobs for no legal reason. According to Wasden, this is also hurting American business.
Following the Biden administration’s decision, wives of H-1B and L-2 visa holders will no longer have to apply for work authorization and will need an employment authorization document as proof to work in the US. Under the agreement, the wives of H4 visa holders have a legal right to stay in the US and they only need to renew their employment authorization.
H4 visas are granted to people who are their relatives and live in the US with H-1B visa holders. However, according to the new decision, the earlier restrictions on H-4 visa holders under the policies of the US Citizenship and Immigration Services will no longer be there.
