What is the code of conduct?
Let us tell you that the Election Commission has made some rules to conduct fair and free elections across the country. These rules are called code of conduct. The Model Code of Conduct is not a rule made by law, rather this rule has been made unanimously by all the political parties and everyone has to follow it.
Code of conduct was implemented for the first time in Kerala
The Model Code of Conduct was implemented for the first time in the Kerala Assembly elections in 1960. Under which some rules were fixed for the candidates as to what they have to do and what not. After this, for the first time in the Lok Sabha elections held in 1962, the Election Commission informed the political parties about this. Whereas, it was implemented for the first time in the 1967 Lok Sabha and Assembly elections and since then this trend continues even today.
Everyone has to follow the rules
The code of conduct comes into force as soon as the election dates are announced. Which continues till the election results are declared. These rules have to be followed by everyone including political parties, candidates, government and administration participating in elections.
There are restrictions on these things in the code of conduct
Central or state governments cannot make any new scheme or announcement after the implementation of the Code of Conduct. Bhoomi pujan or inauguration cannot take place during this period. Government resources cannot be used in election preparations. Use of any kind of government property and other resources is prohibited. As soon as the code of conduct comes into force, party slogans and propaganda materials are removed from the walls. There is also a ban on putting up banners, posters and hoardings.
Similarly, political parties have to take permission from the administration before holding rallies, processions or meetings. Religious places and symbols are also not used during elections. Voters cannot be bribed. Personal attacks cannot be made on any person or party. Apart from this, there is a ban on the sale of liquor on the day of voting and 24 hours before it.
This action is taken on violation of code of conduct
As soon as the code of conduct comes into force, the government employees of the state become employees of the Election Commission. This process continues till the elections are over. They have to work only on the guidelines given by the Commission. Along with this, they also ensure compliance with the instructions issued by the Election Commission.
If anyone is found violating these rules, the Election Commission has full authority to take action against him. The Commission can also prevent a candidate from contesting elections. An FIR may be registered against a candidate who violates the rules and he may also have to go to jail.
