The issue of OBC reservation is hot again, the government is preparing to go to the Supreme Court

The Central Government is going to file a review petition in the Supreme Court to allow reservation to Other Backward Classes (OBCs) in local bodies. SC had recently scrapped the 27 per cent reservation fixed for OBCs in local bodies of the Maharashtra and Madhya Pradesh governments. Confirming this, Union Education Minister Dharmendra Pradhan said that the proposal is under consideration.

In a tweet, Pradhan, BJP’s prominent OBC face, said that the Madhya Pradesh government will also file a review petition in the Supreme Court. He hit out at the Odisha government for not joining the legal battle to restore OBC reservation in local bodies. A few days back, the Ministry of Social Justice and Empowerment had said that the states should follow all the norms laid down by the Supreme Court for elections to local bodies as per the provisions of the Constitution in this regard. The ministry had said that it is also considering filing a review petition before the SC to allow OBC reservation in local bodies and municipal corporations, unless the states follow the three-stage process norms laid down by the apex court. Huh.

These criteria include setting up of a commission to comprehensively examine the nature and implications of backwardness with respect to local bodies in the state. In the second step, the proportion of reservation required to be made local body-wise provision as per the recommendations of this Commission is to be clarified. The third condition is that the number of seats reserved for Scheduled Castes, Scheduled Tribes and OBCs should not exceed 50 percent of the total strength.

The Center said that it is serious about the matter and is looking into the issue after taking into account the views of all stakeholders including the Ministry of Panchayati Raj, Ministry of Parliamentary Affairs, Department of Legal Affairs and Ministry of Home Affairs. The Supreme Court had recently directed the State Election Commission of Maharashtra to notify as the general category 27 per cent seats in local bodies that were reserved for OBCs. After this, the court had directed the State Election Commission to stop the election process on seats reserved for Other Backward Classes in local bodies in Madhya Pradesh and re-notify those seats for the general category.

There were political reactions to this as well. Senior BJP leader Uma Bharti claimed that Panchayat elections in Madhya Pradesh without OBC reservation would be an injustice to nearly 70 per cent of the state’s population.

State Chief Minister and Leader of the House Shivraj Singh Chouhan while presenting the proposal said that the state government wants justice to every section of the society, justice to OBCs too, this is the government’s commitment.
