The court said that it has become a trend nowadays that people are venting their anger and frustration by making indecent remarks on respected people on social media. Freedom of expression does not mean that anyone is licensed to use any type of language. Justice Sanjay Kumar Singh has given this order while rejecting the chargesheet and cancellation of FIR by Niyaz Ahmed Khan of Siddharthnagar, accused of forwarding objectionable pictures of Prime Minister Narendra Modi and Home Minister Amit Shah on Facebook.
Summons order was challenged
The allegation against the accused is that he forwarded an edited fake photo of Prime Minister Narendra Modi shaking hands with international terrorist Hafiz Saeed, which was posted by a person named Anil Sharma. Similarly, the accused also shared the objectionable picture of Prime Minister and Home Minister Amit Shah. In which the edited fake photo of both was inserted. This picture was posted on Facebook in the name of Akhilesh Yadav supporter and forwarded by the petitioner. In respect of which a case was registered against him. After investigation, the police filed a charge sheet against the accused. On which the subordinate court had summoned the petitioner by issuing summons. The summons order and the charge sheet were challenged in the High Court.
take immediate action
The court, after hearing the entire matter, said that at this stage, the court has to see only whether prima facie it appears to be a cognizable offense or not. Going by the charge sheet and the FIR, it cannot be said that cognizable offense has not been committed. The court dismissed the application and directed the central and state government to take immediate effective steps to stop the misuse of social media. A copy of the order has been directed to be sent to the Union Home Secretary and Chief Secretary Uttar Pradesh.
