The Consumer Disputes Redressal Commission has imposed a fine of Rs 11.23 lakh on the hospital administration in the case of death of a patient due to negligence of a hospital doctor in Mahisagar district of Gujarat. The commission has ordered the hospital administration to pay compensation at the rate of 7.5 percent annual interest.
The patient went to the hospital for the treatment of stones
india today According to reports, Devendrabhai Rawal, a resident of Wangroli village in Kheda district, had approached Dr Shivubhai Patel at KMG General Hospital in Balasinor town in May 2011 after complaining of back pain and difficulty in urinating. The investigation revealed that he had a 15 mm kidney stone. On this it was suggested to go to the hospital with facilities for better treatment, but he expressed his desire to undergo the operation at KMG Hospital itself.
Doctor removed kidney instead of stone
According to the doctor’s instructions, Devendrabhai Rawal reached KMG General Hospital on September 3, 2011 and then his operation started. After some time the doctor told that he had removed the kidney instead of the stone. This was a decision made keeping the patient’s health in mind. Devendrabhai’s family members were once stunned after hearing this, but later they were satisfied when the doctor assured everything was correct.
Devendrabhai died in January 2012
After the stone operation, Devendrabhai Rawal started having more trouble urinating. As his condition worsened, his family members first admitted him to the kidney hospital in Nadiad, but as his condition worsened, the hospital administration took him to the Institute of Ahmedabad in Ahmedabad. In view of the hospital’s negligence in the matter, Devendrabhai Rawal’s wife Meenaben had filed a complaint with the Consumer Disputes Redressal Commission of Nadiad. After hearing this, the commission had dismissed the doctor, the hospital and United India Insurance Company Limited in the year 2012 for medical negligence. 11.23 lakh was ordered to be paid, but the insurance company had told the incident not to come under the purview of claim.
Commission ordered to pay compensation to the hospital administration
After the appeal of the insurance company, now the state commission has ordered the hospital administration to pay the compensation. The commission said that the insurance company is not responsible for the medical negligence on the part of the treating doctor. The hospital is not only responsible for its own actions and omissions, but is also responsible for the negligence of its staff. In such a situation, the hospital will have to pay compensation with interest of 7.5 percent from the year 2012 till now.
Removal of kidney without approval is gross negligence- Commission
The commission said that the hospital had performed surgery to remove the stone and had taken consent from the patient only to remove the stone, but his kidney was removed. This is clearly a case of gross negligence on the part of the doctor and the hospital.
