A few days ago, the Ministry of Social Justice has sent a recommendation, in which the possession of small quantities of drugs for personal use has been sought to be exempted from the category of crime. For this, the ministry has suggested amendment in the NDPS Act, so that people who use drugs or are dependent on drugs as victims. It has been said in this recommendation that instead of jailing such people, they should be sent to rehabilitation centers, so that they can be reformed.

Actually, in India, consuming intoxicants or keeping them close is a criminal offence. Section 27 of the NDPS Act provides for imprisonment of up to one year or fine up to Rs 20,000 or both for the use of any intoxicating substance or psychotropic substance. This section does not differentiate between drug addicts, first time drug users and simply amateurs. Therefore, there is a demand for amendment in it.
Section 27 of the NDPS Act has been used in many high-profile cases. The arrest of Shahrukh Khan’s son Aryan Khan is also one of such cases. Therefore, the Social Justice Ministry has suggested that the law should bring people caught with drugs only for personal use out of jail sentence and sent them to rehabilitation centres.
