The woman is ready to withdraw the allegations against Bhushan Kumar. But the Bombay High Court has rejected Bhushan Kumar’s petition while giving its verdict. Moreover, the court has said that a rape case cannot be quashed just because the victim gives consent… hence Bhushan Kumar’s troubles are increasing.
As far as the whole matter is concerned, Bhushan Kumar filed a petition seeking quashing of the FIR after the woman agreed to withdraw the charges and drop the case. A bench of Justices AS Gadkari and PD Naik held that mere consent of the complainant is not sufficient ground to quash the FIR alleging rape. In the rape case, the court said that the consent of the opposite party does not mean that the FIR will be canceled under section 376 of the Indian Penal Code. The next hearing of this case will now be on July 2, 2023.
