A vacation bench of Justices Surya Kant and J B Pardiwala said it had asked to list a matter for hearing on Monday but the registry has said that it will not be listed.
The bench told senior advocate Abhishek Manu Singhvi, “We did not want to say it in open court but it is a fact. Yesterday we made an exception and directed listing of one case for today. But the registry said it would not list the matter. We don’t want to say anything more about this.
Singhvi was seeking immediate listing of a petition filed by Adani Ports and Special Economic Zone (Adani) against the Bombay High Court order.
The bench said that there is a prescribed procedure for listing of matters during the vacation and asked Singhvi to approach the registrar. The court said that if the request for listing is rejected, it can consider it.
Singhvi said that the discretion of the Court cannot be limited by the Registry and it can immediately list the matter as an exception.
The same vacation bench had on Monday also ordered listing of a petition filed in Mumbai regarding providing security to industrialist Mukesh Ambani and his family members for hearing on Tuesday. However, the matter was not listed for Tuesday despite the order of the bench.
The government’s protection to the Ambani family was challenged through a public interest litigation. The Center has filed a petition in the court against the order of the Tripura High Court on this.
